These Terms & Conditions apply to all purchases made from Birchward Ltd, trading as Birchward Bicycles, through our website.

By placing an order with us, you agree to these Terms & Conditions.

2. Who These Terms Apply To

These Terms apply to:

  • consumers buying for personal use; and
  • businesses buying for trade, commercial or professional purposes.

If you are buying as a consumer, you have legal rights under UK consumer law. Nothing in these Terms affects those rights.


3. Products

We sell bicycles, bicycle parts, accessories, tools, clothing, helmets and related products.

We make reasonable efforts to ensure product descriptions, images, prices and availability are accurate. However, images are for illustration only and colours, packaging or minor product details may vary.

You are responsible for checking that a product is suitable for your needs before ordering.


4. Orders

When you place an order, you are making an offer to buy the products in your basket.

Your order is only accepted when we confirm dispatch or otherwise confirm acceptance by email.

We may refuse or cancel an order where:

  • the product is unavailable;
  • there is an error in the price or description;
  • payment is not authorised;
  • we suspect fraud or misuse;
  • delivery cannot be made to the address provided;
  • the order appears to be for resale or commercial use that we have not agreed to.

If we cancel an order after payment has been taken, we will refund you.


5. Prices and Payment

All prices are shown in pounds sterling (£).

Prices include VAT where applicable unless stated otherwise.

Delivery charges are shown separately at checkout.

Payment must be made at the time of order using the payment methods available on our website.

We do not store full card details. Payments are processed securely by third-party payment providers such as Stripe, Google Pay or other payment services.


6. Delivery

We will deliver to the address provided at checkout.

Estimated delivery times are shown on our website or during checkout. Delivery times are estimates only and are not guaranteed unless expressly stated.

If delivery is delayed, we will contact you where possible.

Risk in the products passes to you when the products are delivered to you or to someone you nominate to receive them.

Ownership of the products passes to you once we have received full payment.


7. Failed Delivery or Incorrect Address

You are responsible for providing a complete and accurate delivery address.

If an order is returned to us because:

  • the address was incorrect;
  • the parcel was not collected;
  • delivery was refused; or
  • the courier could not complete delivery,

we may charge you for any additional postage or courier costs before resending the order.


8. Your Right to Cancel — Consumers Only

If you are buying as a consumer online, you usually have the right to cancel your order within 14 days after the day you receive the goods. You do not need to give a reason.

You then have 14 days from telling us you wish to cancel to return the goods.

Goods must be returned in a condition that allows us to resell them as new, unless you are returning them because they are faulty.

You are responsible for return postage costs unless the item is faulty, damaged, misdescribed, or we have agreed otherwise.

We will refund the price paid, including standard delivery, within 14 days of receiving the returned goods or evidence that you have sent them back. If you selected a premium delivery option, we only refund the cost of standard delivery.


9. Items That Cannot Be Returned for Change of Mind

Your cancellation rights may not apply to:

  • personalised or custom-made products;
  • sealed items that are not suitable for return for hygiene reasons once opened;
  • products that have been used beyond what is necessary to inspect them;
  • perishable items or products with a short shelf life;
  • items damaged after delivery.

This does not affect your rights if an item is faulty.


10. Faulty, Damaged or Misdescribed Goods

We are responsible for supplying goods that are as described, fit for purpose and of satisfactory quality.

If goods are faulty, damaged or misdescribed, please contact us as soon as possible at:

Consumers generally have a short-term right to reject faulty goods within 30 days and receive a refund. After that, consumers may be entitled to a repair, replacement or other remedy depending on the circumstances.

We may ask you to provide photos or return the item so we can inspect it.

If the goods are confirmed to be faulty, damaged or misdescribed, we will cover reasonable return postage costs.


11. Returns Process

To return an item, please contact us first with:

  • your order number;
  • your name;
  • the product you wish to return;
  • the reason for return;
  • photos if the item is damaged or faulty.

12. Product Safety and Use

You are responsible for using products safely and in accordance with any manufacturer instructions.

For bicycles, bike parts, helmets, tools and safety-related items, you should ensure they are fitted, adjusted and maintained correctly.

Where appropriate, installation or fitting should be carried out by a competent person or qualified mechanic.

We are not responsible for damage, injury or loss caused by misuse, incorrect installation, poor maintenance, modification, or failure to follow manufacturer instructions.


13. Manufacturer Warranties

Some products may include a manufacturer warranty.

Manufacturer warranties are provided by the manufacturer, not by Birchward Bicycles, unless we expressly state otherwise.

Your statutory rights are separate from and in addition to any manufacturer warranty.


14. Business Customers

If you buy from us as a business, you confirm that you have authority to bind that business.

For business customers:

  • consumer cancellation rights do not apply;
  • returns are accepted only at our discretion unless the goods are faulty or misdescribed;
  • we may charge restocking, handling or return delivery fees;
  • we are not liable for loss of profit, loss of business, loss of goodwill, loss of opportunity or indirect losses.

Nothing in these Terms excludes liability where it would be unlawful to do so.


15. Resale and Marketplace Use

Unless agreed in writing, products are supplied for normal end use.

If you buy goods for resale, marketplace trading, export, or commercial distribution, you are responsible for ensuring that:

  • the products are suitable for resale;
  • all legal, tax, labelling and product safety requirements are met;
  • you comply with any brand, marketplace or manufacturer restrictions;
  • you handle customer returns and product issues correctly.

We reserve the right to refuse or cancel orders that appear to be for unauthorised resale, bulk buying, fraud, abuse, or activity that may damage our business or supplier relationships.


16. Discount Codes and Promotions

Discount codes and promotions are subject to availability and may be withdrawn or changed at any time.

Discount codes:

  • cannot usually be used with other offers unless stated;
  • may be limited to certain products or categories;
  • may have expiry dates;
  • have no cash value.

We reserve the right to cancel orders where a discount code has been misused.

We do not charge you to receive marketing texts, but your mobile provider may charge standard message or data rates.

  • courier delays;
  • strikes;
  • severe weather;
  • supply chain disruption;
  • IT outages;
